A defendant shall be punished by imprisonment with prison labor for up to six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On December 20, 2018, the Defendant received a proposal from an employee of telecommunications fraud (tentatively referred to as “Singing”) of the name named “B,” to the effect that “I would introduce work loans, I would be able to create a transaction performance due to low credit rating of the Party, and would be exempted from withdrawing and delivering money deposited into the account under the name of the Party,” and then notified the above “B,” of the account number and password of the company bank account in the name of the Defendant, and D Bank account (Account Number C).

On December 20, 2018, at around 10:36, 2018, a personal information of a party was leaked to investigative agency and the Financial Supervisory Service, and when misrepresenting the victim F, the victim made a false statement, stating, “I have to carry a criminal with setting snares and traps, and have the victim bring money to a corporate bank account in the name of the above defendant.” The victim transferred KRW 54 million to the victim’s corporate bank account in the name of the above defendant.

On December 21, 2018, the Defendant transferred only the above 54 million won deposited in the account of the pertinent company bank according to the direction of “B” to the said bank account, withdrawn the amount of KRW 30 million from the main point of the D bank located in Michuhol-gu Incheon Metropolitan City to the name-free member of the D Bank who sent the above KRW 54 million from the main point of the D Bank located in Michuhol-gu to the name-free member of the B, and then withdrawn the remainder of KRW 24 million from the main point of the D Bank located in the Nam-gu Incheon Metropolitan City, and then delivered the name-free singing employee sent by the said “B.”
