B A stock company is a corporation established for the purpose of the business of manufacturing aggregate crushing and the business of screening aggregate with its head office located in Gyeonggi-gun C, and the defendant A is a representative director of the defendant B, who exercises overall control over and manages the safety and health of workers belonging to the place of business.

1. Defendant A’s nationality network D is a person who, around March 24, 2019, became a member of the Company B and had engaged in the work, such as replacement of parts, in a consortium which selects the crushed stone at the said workplace.

A defendant who exercises overall control over and manages safety and health matters in the above workplace shall take measures to prevent industrial accidents, such as installation of a device that can immediately suspend the operation of a consortium, etc., in case of a consortium, etc., where the physical part of the relevant worker might be projected down, etc., and in case of an emergency.

Nevertheless, the Defendant neglected such measures and failed to install an emergency stop device that could promptly suspend the operation of a consortium, i.e., when an emergency situation occurs, resulting in the death in the site of the facility, by collecting the remaining remaining rocks that were not screened through a consortium belt and a steel scrap network, in order to bring about the network replacement work conducted on November 30, 2019.

2. Defendant B, the representative of Defendant B Co., Ltd., committed the Defendant’s business violation as described in paragraph (1) above.
