A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

The defendant is a person who is engaged in the operation of a Bbee cruise car.

1. On July 16, 2015, the Defendant violated the Act on Special Cases Concerning the Settlement of Traffic Accidents (hereinafter “Special Cases Concerning the Settlement of Traffic Accidents”), around 22:40, the roads in front of the Daegu-gu area of 91.1km (Yancheon-si, Young-si, North Korea), from the front side of the racing to the Daegu-do area.

In such cases, the driver has a duty of care to safely drive after checking the lane intended to change if it is necessary to change the course.

Nevertheless, the Defendant neglected this and changed the two lanes from the two lanes to the one lane under the influence of alcohol 0.143% in blood, and caused injury to the victim E (the 49 years old) who was driving on the said two lanes of the said road by collision with the part of the Korean common 27 tons in the left-hand side of the cruise car, resulting in the injury of the victim C, such as catum catum, tension, etc. requiring approximately three-day medical treatment, and at the same time, suffered injury to the victim E (the 49 years old) who was driving on the same vehicle for about six-day medical treatment.

2. On November 23, 2006, the Defendant was sentenced to a suspended sentence of two months for a violation of road traffic laws at the Daegu District Court on the grounds of a violation of road traffic laws, etc. On January 28, 201, the Defendant was sentenced to a suspended sentence of two million won for a fine of two million won for a violation of road traffic laws at the Ulsan District Court on January 28, 201, and on April 9, 201, the Defendant was sentenced to a suspended sentence of two months for a violation of road traffic laws at the Ulsan District Court on the grounds of a violation of road traffic laws.

The Defendant, while under the influence of alcohol 0.143% in blood at a time as referred to in paragraph (1), driven the said car at approximately 10 km from the Yancheon-si's Yancheon-si to the front road of the 91.1km located in Daegu-si, Busan-si (Yancheon-si Northwest-do Po-si).
