피고인은 동거 중이던 피해자 B(여, 48세)가 피고인에게 이별을 통보한 후 집을 나간 뒤 인근 사찰에서 지내자, 2015. 3. 15. 16:21경 충북 단양군 C에 있는 D모텔 402호에 피해자를 데리고 들어가, 피해자에게 “씨발년아, 같이 살자는데 왜 안 사냐. 니가 땡중과 만나면서부터 변했다, 너 땡중이랑 성관계 했지.”라고 말하면서 피해자가 도망가지 못하도록 피해자의 휴대전화를 빼앗고 피해자가 입고 있던 옷을 모두 벗긴 뒤 손으로 피해자의 음부와 가슴을 만진 다음, 피해자에게 재차 동거할 것을 요구하였으나 피해자로부터 거절당하자 피해자를 침대에 눕히고 배 위에 올라타 양손으로 피해자의 목을 조르고 “니가 거긴 어딜 가 씨발년아, 너는 뒤져야 해.”라고 말하면서 주먹으로 피해자의 허벅지와 머리를 때리고 손바닥으로 얼굴을 수회 때리는 등 같은 날 20:12경까지 위 모텔 방에서 나오지 못하게 하였다.
