Punishment of the crime

Defendant D was sentenced to eight months of imprisonment with prison labor and two years of suspended execution for a crime of fraud at the Daegu District Court on April 21, 2015, and the judgment became final and conclusive on August 23, 2016, and Defendant E was sentenced to six months of imprisonment with prison labor for a stolen property at the Sejong District Court's site site on June 4, 2013, and completed the execution of the said punishment on July 9, 2013.

Although Defendant D, Defendant C, Defendant C, Defendant A, M, and N applied for the amendment of a bill of indictment to one of the charges of fraud in the two cases joined on September 5, 2016, Defendant A and the Defendants charged for the same crime were not completely changed in the subject and scope of indictment, and the Defendants charged for the same crime were deemed not to have any impediment to the exercise of the Defendants’ right to defense, and thus, the same facts charged were corrected as above without the amendment of indictment.
