A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. The Defendant is a person who is engaged in driving a rocketing car.
On November 10, 2017, the Defendant driven the said car at a speed of about 60km per hour according to the four-lanes between five lanes in length and four-lanes.
Since there is a road where signal lights are installed, there was a duty of care to safely drive the vehicle driving employee by complying with the signal.
Nevertheless, the Defendant, without obtaining a driver’s license, e.g., driven by the victim D(61 aged) who walked in accordance with the new subparagraph on the opposite vehicle line due to a sudden negligence in violation of a stop signal under the influence of alcohol content of 0.138% in blood during blood, without having a driver’s license, shocked the front part of the right upper part of the Defendant’s car in front of the car.
As a result, the Defendant suffered, by negligence in the above business, the injury to the victim D, such as salt, tensions, etc., which requires approximately two weeks of treatment, and the injury to the victim F (V, 37 years of age), which requires approximately two weeks of treatment.
2. On November 10, 2017, the Defendant: (a) driven a B rocketing car under the influence of alcohol content of 0.138% in blood without obtaining a driver’s license from a section of about 800 meters from the front of a H cafeteria located in Daejeon Seo-gu G to the accident site referred to in paragraph (1).
