Defendants shall be punished by a fine of three million won.

In the event that the Defendants did not pay the above fines, only 100,000.

Punishment of the crime

On July 2016, the Defendants engaged in the so-called “E” business under the name of “E” in Seocheon-gu, Seocheon-gu, Seocheon-gu, Seocheon-gu, in order to operate the business and divide the profits and expenses therefrom. Defendant A registered the business with the trade name of “F” from the second floor of the above building, the trade name of “G” from the third floor, and Defendant B with the trade name of “H” from the fourth floor of the above building.

1. A person who intends to operate an entertainment shop business in violation of the Food Sanitation Act shall obtain permission from the head of a Si/Gun/Gu, as prescribed by Presidential Decree;

Nevertheless, the Defendants conspired as above from July 26, 2016 to August 5, 2017, when operating the “E” without obtaining permission from the head of the Seo-gu Northernbuk-si, etc., and in “F” and “G”, the Defendants set up the table, table, special lighting, etc. in “H” and “H”, and made customers in “F” and “G” able to dance in music while drinking alcohol.

As a result, the Defendants conspired to engage in entertainment center business without obtaining permission.

2. A person who intends to change the purpose of a building approved for use in violation of the Building Act shall obtain permission from the head of a Si/Gun/Gu, etc., as prescribed by Ordinance of the Ministry of Land, Infrastructure and Transport.

Nevertheless, the Defendants conspired as above from July 26, 2016 to August 5, 2017, by allowing customers to dance in line with music as described in paragraph (1), and used “F” 238.68 square meters and “H” 197.18 square meters, and “G” 238.68 square meters, which were approved to be used as “general restaurant” belonging to the group of the 4th military cultural and assembly facilities, respectively.

Accordingly, the Defendants conspired to obtain permission.
