A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. No person who violates Emergency Medical Services Act shall interfere with the rescue, transfer, first-aid or medical treatment of an emergency patient by emergency medical personnel by means of violence, intimidation, deceptive scheme, threat of force or other means;

2. Interference with business;
A. From around 23:50 on September 30, 2019 to 23:57 on the same day, the Defendant, while avoiding disturbance at the places specified in paragraph (1) from around 23:50 on September 30, 2019, sent the disturbance to the outside of the emergency room by the security personnel E and D, he continued to put the patient in the emergency room into the care of the patient in the emergency room, and interfered with the duties of the security personnel for seven minutes by causing the disturbance of “grings, widths, etc.” to the security personnel.
Accordingly, the defendant interfered with the duty of civil petition guidance of the emergency security personnel in the emergency room by force.
