A은 익산시 C에 있는 피고인 농업회사법인 B 주식회사를 실질적으로 운영하는 사람이고, 피고인 농업회사법인 B 주식회사는 ‘D 사업 ’으로 국가 및 지방자치단체로부터 보조금을 지원 받아 즉석 떡볶이 등을 제조 판매하는 회사이다.

그럼에도 불구하고 피고인 A은 2015. 12. 28. 경 보조금 2억 1,000만 원( 국비 1억 9,425만 원, 지방비 1,575만 원) 을 교부 받아 위 사업장의 내포 장실을 보수하고, 즉석 떡볶이 포장라인 및 폐수처리시설 증설하였음에도 불구하고, 익산시장으로부터 미리 승인을 받지 아니하고, 2016. 11. 7. 경 익산시 E에 있는 농업회사법인 주식회사 F 사무실에서, 그 곳 대표 G에게 1억 9,500만 원에 위 사업장을 양도하였다.
