1. Defendant B: (a) each of the KRW 300,000 to the Plaintiff (Appointeds) and the Appointeds; and (b) from January 5, 2017 to May 1, 2018.

1. Basic facts

A. As of December 2, 2014, the Plaintiff (Appointeds) and the designated parties (hereinafter referred to as “Plaintiffs”) were the resident autonomy members of the Dong-gu Incheon Metropolitan City as of December 2, 2014, and Defendant B was issued as the head of the Dong-gu Incheon Metropolitan City Office on July 3, 2014.

B. From October 2014, the Plaintiffs, including Plaintiff D, who was the secretary of the Residential Self-Governing Committee, had conflict with Defendant B as a matter of expenditure of the resident center operation fund.

C. Defendant B was amended by Ordinance No. 1244 of the Nam-gu Incheon Metropolitan City Ordinance on May 15, 2015 to three legal advisers of the Nam-gu Incheon Metropolitan City on December 12, 2014.

In accordance with the "Ordinance of this case", the person subject to dismissal is included in the incumbent members when the member is dismissed. ② The "Deliberation of the Committee" required for the dismissal of the member of the residents' autonomous council shall not necessarily go through the deliberation and resolution but rather, if the meeting is held to the extent that the agenda is discussed, and ③ the head of the Dong requested legal advice on what is the most smooth way to dismiss the member of the residents' autonomous council.

In this regard, two attorneys-at-law responded to the purport that they are not included in the registered members, and one attorney-at-law responded to the fact that they are included in the registered members.

On December 22, 2014, Defendant B requested 11 members of the residents' autonomous council, excluding three advisers and ten plaintiffs, from among 24 members of the residents' autonomous council around December 24, 2014.

E. The above commission was convened by Defendant B, who is not the chairman of the convening authority.
