The plaintiff's claim is dismissed.
Litigation costs shall be borne by the plaintiff.
Reasons
Plaintiff
On March 11, 2018, at around 14:00, the Plaintiff suffered an injury to the upper part of the upper part of the upper part of the upper part of the border, which was installed between the sidewalk and the roadway, while walking the front part of the F, of Bupyeong-gu Incheon Metropolitan City.
The defendant is a local government that installs a sidewalk and a roadway of the above road owned by the defendant, and occupies, preserves, and manages them, and is responsible for compensating for damages of 43,25,007 won (=affirmative damages of 12,081,134 won) caused by the injury of the plaintiff due to the defect in the installation and preservation of the above sidewalk and boundary (=2,173,873 won).

In full view of the overall purport of the pleadings at the video of Nos. 2, 4 through 6, Eul evidence Nos. 3, and Eul evidence No. 3 (including paper numbers), the Plaintiff suffered an injury to a bridge by putting the road over the boundary line (hereinafter “instant boundary line”), which is located on March 11, 2018, in order to move to a building in the middle of the Incheon Bupyeong-gu, Incheon, in order to walk up a road, while walking around 14:00, around March 11, 2018. The instant boundary is installed on the boundary of the sidewalk and the road, and there is a difference between the sidewalk and the road.
In full view of the following circumstances as to whether a difference of about 5 cm between the boundary stone and the sidewalk of this case constitutes a defect in the installation or management of the boundary stone and the sidewalk of this case, the evidence submitted by the Plaintiff alone cannot be deemed as a defect in the installation or management of the boundary stone or the sidewalk of this case, and there is no other evidence to acknowledge this differently.
Therefore, the plaintiff's assertion is without merit without examining the remainder of the issue.
(2) Where a roadway is divided into a roadway and a sidewalk pursuant to paragraph (1), the following standards shall apply:
