A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above sentence shall be suspended for one year and six months from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On February 20, 2016, the Defendant: (a) around 20:15, 2016, the Defendant: (b) boarded the victim D (60 tax) on the cab in front of the Nam-gu Busan metropolitan convenience store; (c) changed the place of the said cab several times; and (d) opened the door of the said cab in front; (c) around 21:00 on the same day, the victim reported the said cab to 112, after stopping the said cab on the front of the 1 public security center located in the south-gu Busan metropolitan area around 27, Busan metropolitan area around 21:0.

그러자 피고인도 차에서 내려 손으로 피해자의 멱살을 잡아 흔들며 “ 야, 이 새끼야! 너 이름이 뭐야 신분증 꺼 내봐! ”라고 욕설하였다.

Accordingly, the defendant committed assault against the victim.

2. 공무집행 방해 피고인은 제 1 항과 같은 일시, 장소에서, 신고를 받고 출동한 부산 남부 경찰서 F 지구대 소속 순경 G 등이 피고인을 제지하기 위하여 팔을 붙잡자 순간적으로 팔을 빼낸 후 손으로 G의 뺨을 때리고, 이어 피고인의 지인에게 인계하기 위하여 G 등으로부터 보호조치되자 “ 개새끼들아! 내가 여기 왜 있어야 되는데 씹할 놈들아! 조폭들 앞에서는 꼬치를 딸랑딸랑 하면서 내한테 왜 지랄이고 ”라고 욕설하며 발로 G의 정강이를 걷어찼다.

Accordingly, the defendant interfered with legitimate execution of duties concerning the prevention, suppression and investigation of police officers' crimes.
