1. The summary of the grounds for appeal (unfair sentencing) by the lower court (one year of imprisonment with prison labor for six months and one year of suspended sentence) is too unfased and unreasonable.

2. In full view of the circumstances indicated by the lower court in the grounds for sentencing and all of the sentencing conditions shown in the records and arguments of this case, the sentence imposed by the lower court is deemed appropriate, and it does not seem unfair as it is too low.

3. In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the appeal is without merit. It is so decided as per Disposition.
