A defendant shall be punished by imprisonment for one year.

Punishment of the crime

On November 20, 2008, the Defendant sentenced 6 years to imprisonment with prison labor for robbery, injury, etc. at Seoul High Court on November 20, 2008, and completed the execution of the sentence on February 17, 2014.

At around 21:00 on August 13, 2014, the Defendant: (a) posted a letter on the victim D’s house located in Seocheon-gu C Apartment, Seocheon-gu, Seocheon-gu, Incheon, stating that he would sell a vehicle to the “E” site (F); (b) confirmed G low-speed car owned by the victim; (c) confirmed the victim’s vehicle at the time of the So-gu office located in the old old-ro 73 at around 10:00 of the same month; and (d) said, the Defendant is only H commercial employee in front of the So-gu Office located in the same old-ro 73 of the same month. Since the person to purchase the vehicle was directly taken place, the Defendant did not mention about the sale price. If the Defendant affixed a seal on the power of delegation for the transfer of the vehicle and the vehicle price, the Defendant would have the commercial agent pay the purchase price in KRW 31 million.”

However, the defendant was not H officer, and even if he was entrusted with the sale of the above vehicle by the victim, he did not have the intent or ability to pay the price to the victim.

On the same day, the Defendant acquired the above vehicle from the victim under the pretext of consignment sale at the market price of KRW 26,000,000.

On February 9, 2015, the Defendant, using the I's mobile phone device in order to pretend that he is the birthee at a place that cannot be known at around 09:30 on February 9, 2015, sent back to the victim J who has transacted with Pyeongtaek I and then want to sell the victim with '2013 high-ranking vehicle'.

The name which was stamped in advance by the above mobile phone period was sent to the low-est passenger car photograph owned by the person who could not know the name which was stamped.
