Reasons
Punishment of the crime
On February 14, 2014, the Defendant of criminal records was sentenced to two years of imprisonment with prison labor for fraud in the Gwangju District Court's Netcheon Branch on February 14, 201, and the sentence becomes final and conclusive on February 22, 2014. ② On May 14, 2014, the same court was sentenced to two years of suspension of execution for three months of imprisonment with prison labor for the same crime, and the sentence becomes final and conclusive on May 22, 2014, and is still under suspension of execution.

1. On August 30, 2014, at the office of 307 of the D Building No. 307, the Defendant: (a) posted the aforementioned mobile phone photograph to the effect that he/she sells goods of “S4” in the “E” on the Internet’s main trading site; (b) reported the above bulletin and contacted the victim C by stating that “70,000 won is to be sold on the face of transfer of KRW 70,00,000”; and (c) received KRW 70,000 from the victim’s bank account in the name of F, the Defendant’s seat at the same time.
However, the defendant did not have the above mobile phone, and even if he received the mobile phone sales proceeds from the victim, he did not have the intention or ability to sell the above goods normally.
Accordingly, the defendant was given property by deceiving the victim.
2. On September 4, 2014, at the 307 Office of the D Building No. 307, the Defendant: (a) reported the victim G’s comments to purchase 4 S4 mobile phone at the “E” website of the Internet, and (b) made a false statement to the victim that “40,000 won is to sell S4 mobile phone at the gallon city on the face of a transfer of 40,00 won”; and (c) received KRW 40,000 from the victim to the agricultural bank account in the name of H, the Defendant’s seat at the same time.
However, the defendant does not have the above mobile phone so that he/she can sell the above goods normally even if he/she receives the mobile phone sales proceeds from the victim.
