A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant and the victim B (the age of 57) maintain de facto marital relations, and live together from around 2008 to the present.

On May 1, 2020, the Defendant, at around 11:30 on May 11, 2020, filed two parts of the metal products ( approximately 94 cm in length, about 45 cm in width), which are dangerous things in the kitchen, continuously being placed in the kitchen in a ward, on the ground that the victim's sexual intercourse is refused and money is not given, and the victim does not know about the number of days to be treated.

Accordingly, the defendant carried dangerous objects and inflicted bodily injury on the victim.

B’s photograph of the steel product in this case, the victim’s photograph, the victim’s photograph, and the defense counsel asserted that the defendant did not have any intention to inflict an injury on the victim, and that the defendant was not guilty of special injury because the victim could not have been predicted to inflict an injury.
