1. Defendant A shall be punished by imprisonment for eight months, by a fine of KRW 5,00,00,000, and by imprisonment for one year.
Reasons
Punishment of the crime
1. The basic facts G went through difficulties in operating the I Hospital from April 27, 2008, which had been located at H at the Sasi-si. Around June 3, 2009, G did not pay a check issued by G, etc.
Accordingly, G transferred the name of the above I Hospital to Defendant A on June 17, 2009 upon the obligees’ solicitation, but in substance, G continued to operate. Defendant A was employed by the above I Hospital from June 17, 2009 to February 1, 2010 and served as a doctor.

C. Defendant D is an individual creditor of G, and Defendant B is an employee of G, who is a creditor of G.
2. The victim (main) K supplied drugs equivalent to KRW 124,673,797 to an I Hospital from June 17, 2009 to September 30, 2009, and did not receive the price.
On the other hand, around June 17, 2009, Defendant A had a personal obligation of approximately KRW 122,00,000 when being transferred to the name of the said I Hospital, and due to that obligation, Defendant A had a personal obligation of KRW 122,00,000.

A, around June 24, 2009, talked about the above facts on the part of the I Hospital, and the Defendants have the possibility that the claims against Defendant A against the National Health Insurance Corporation may be seized. Although Defendant B did not have the claims against Defendant A, he had the intention to transfer his claims against Defendant A to Defendant B by falsity.
On July 9, 2009, the Defendants: (a) prepared a transfer contract on the assignment of claims to the National Health Insurance Corporation; (b) notified the National Health Insurance Corporation to the transferee B; and (c) changed the account deposited from the National Health Insurance Corporation to the Agricultural Cooperatives under Defendant B’s name.
Since then, the National Health Insurance Corporation from August 4, 2009 to January 29, 2010, the protection claim is as shown in the list of crimes in the attached Form.
