Reasons
1. Summary of the facts charged in this case
A. Defendant A, B, and C are the deputy head of the relevant hospital from February 1, 2014 to August 31, 2014 (hereinafter “instant hospital”), the deputy head of the relevant hospital from September 1, 2014, the head of the relevant hospital from September 1, 2014, the Defendant B is the head of the budget planning office of the said hospital, and the Defendant C is the head of the strategic planning team of the said hospital.
No person shall introduce, arrange or induce patients to medical institutions or medical persons for profit, such as exempting or discounting the individual's share under the National Health Insurance Act or the Medical Care Benefits Act, providing money or other valuables, etc., or instigate such act.
On March 2014, when patients finding a hospital suffer difficulties in operating the hospital due to a small number of time, the Defendants: (a) designated a specific day under the name of "not dedicated to medical treatment" to publicize the hospital to the branch, such as the family members of the hospital; and (b) set up an event plan for "1,500D days, 2,000D days, 3,000D days" to attract patients in a certain target number; (c) assigned three to each department, such as nursing department, to take care of the number of patients introduced by each employee, to select and reward outstanding employees at the end of the year; and (d) introduced them to the extent that employees are placed on more than three occasions upon receipt of three times of direct medical treatment; and (e) intended to have them bear the burden of inducing the patient's family members, such as family members, etc., by using the provision for reduction and exemption of medical expenses.
Thus, on October 9, 2014, the Defendants planned 3,00 days to attract 3,00 patients by setting up 5 patient goals for the introduction of 1 employee at the above hospital, a legal holiday, and then let the hospital employees become the family members of the staff.
