A defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for a period of four years from the date this judgment becomes final and conclusive.

Punishment of the crime

【Common Criminal Records】 On March 28, 2014, the Defendant received a summary order of KRW 3.5 million from the Seoul Eastern District Court to a fine of KRW 3.5 million due to a violation of road traffic laws, and on August 16, 2017, the Incheon District Court issued a summary order of KRW 5 million from a fine of KRW 5 million due to a violation of road traffic laws.

On August 8, 2020, the Defendant parked CK5 motor vehicles in front of Suwon-si, Suwon-si, through an acting driver on behalf of around 04:10 on August 8, 2020, and moved to the seat of the driver. On the same day, the Defendant driven the foregoing motor vehicle at a distance of about 1m alcohol concentration of about 0.203% under the influence of alcohol during blood in around 06:35 on the same day.

As a result, the Defendant driven a motor vehicle under the influence of alcohol not less than twice in violation of the prohibition on drinking.

1. On November 6, 2020, the Defendant driven CK5 cars under the influence of alcohol by 0.12% in the section of approximately 200 meters from the road located in the water-line rescue movement at Suwon-si, Suwon-si to the road in front of the same Gu.

Accordingly, the Defendant driven a motor vehicle under the influence of alcohol not less than twice.

2. Violation of the Traffic Act on roads.

A. On December 1, 2020, the Defendant driving a vehicle without a license on December 1, 2020 set forth in paragraph (1) of the same Article, without obtaining a driver’s license, from a section of approximately 6 km from the right line E in Suwon-si, Suwon-si to the same front road of the same Gu from around 08:32, Dec. 1, 2020.

B. On December 2, 2020, the Defendant driven a car as stated in paragraph (1) of the above paragraph without obtaining a driver’s license from a section of approximately 6 km from the right line E in Suwon-si, Suwon-si, to the same front road of the same Gu, from around 08:13 on December 2, 2020.

On December 3, 2020, the Defendant without obtaining a driver’s license on December 3, 2020, without obtaining a driver’s license on December 3, 2020 from the front side of the Suwon-si Station E, Suwon-si, to the front road of the same Gu, and without obtaining a driver’s license on December 3, 2020.
