A defendant shall be punished by imprisonment for not less than eight months.
The victim C and D's interference with the business of the victim shall be acquitted.
Reasons
Punishment of the crime
The Defendant was sentenced to a fine of KRW 4 million at the Seoul District Court on September 14, 1999 for fraud, etc.; KRW 1 million for fraud at the Seoul Central District Court on December 1, 2000; KRW 2 million for the same crime at the Seoul Central District Court on November 17, 2004; KRW 6 months for habitual fraud at the Seoul East East East District Court on April 9, 2004; KRW 300,000 for fraud; KRW 7 months for the execution of a fine of KRW 3 million at the Seoul Central District Court on March 30, 2007; KRW 3 million for the same crime at the same court on August 28, 2008; KRW 3 million for a fine of KRW 3 million at the same court on the same day; and KRW 1 million for the same offense at the same court on March 1, 2000 for each of the same crimes; and KRW 3 million for a fine of KRW 5 million at the same court on the same date.
1. Habitual fraud;
A. On May 29, 2012, around 05:25, the Defendant: (a) took a F taxi operated by the victim E in the nearest office of the Posi-distance located in Gangnam-gu Seoul Metropolitan Government, and took the same as if he would pay the taxi fee; and (b) demanded the operation to the subway stations located in the Seocho-gu Seoul Metropolitan Government Yangdong-dong.
However, there was no intention or ability to pay taxi charges.
The defendant had the victim operate approximately 1.5 km of the taxi fee of approximately 3,000 won and did not pay the above taxi fee even though he had the victim operate the taxi fee of approximately 1.5 km.
B. On June 17, 2012, around 23:26, the Defendant: (a) took a train operated by the victim G in the vicinity of the subway station located in the Seocho-gu Seoul Metropolitan Yangdong; (b) took the same as if he would pay the taxi fee; and (c) demanded the operation to the entrance of the disputing village located in the Gangnam-gu Seoul Metropolitan Government Seo-dong.
However, in fact, taxi charges shall be paid.
