1. The plaintiff's claim is dismissed.

1. Basic facts

A. On April 4, 2005, the Plaintiff entered into an insurance contract with the Defendant stating that the Plaintiff shall pay insurance money, such as the day of hospitalization, expenses for hospitalization, and medical treatment (hereinafter “instant insurance contract”) in the event of injury, disease, etc. by making the Defendant the insured as the insured.

B. After entering into the instant insurance contract, the Defendant claimed for the payment of the insurance proceeds against the Plaintiff on the ground that the Defendant was hospitalized in B Hospital from June 7, 2006 to June 21, 2006 and was hospitalized in B Hospital from January 10, 2015.

At the request of the defendant, the plaintiff paid the insurance proceeds of KRW 127,293,318 in total to the defendant from June 29, 2006 to January 16, 2015.

C. After entering into the instant insurance contract, the Defendant has maintained the contract by entering into eight insurance contracts with other insurance companies as listed in the following table, and has been paid up until now.
