Basic Facts
The Committee for Promotion of the Regional Housing Association B that promoted the establishment of the defendant association (hereinafter referred to as the "Promotion Committee of this case") is an organization organized to establish a regional housing association under the Housing Act for a housing construction project in the area of 197,180 square meters of land C in Sung-si.
On April 11, 2017, the instant promotion committee entered into an agency contract with D (Before the alteration: E; hereinafter referred to as “D”) to perform all affairs such as financing and execution, business site contracts, selection of service companies, sale in lots, advertisement, etc. in relation to the new apartment construction project of the Defendant association.
Since then, the above agency contract was partially amended on April 25, 2017.
(hereinafter “instant contract for changing the agency business”). The instant promotion committee has publicly announced the recruitment of partners (members of the promotion committee) on May 30, 2017 and recruited its members.
Meanwhile, at the time, the parties to the partnership agreement prepared by the association members to enter into the instant promotion committee and the housing association joining contract (hereinafter “instant housing association joining contract”) were indicated as the representative of the chairperson of the instant promotion committee.
The part related to this case in the subscription contract of the housing association of this case is as follows.
The Committee for Promotion of the Regional Housing Association (tentative name) B (hereinafter referred to as the “Regional Housing Association”) shall enter into a membership agreement on the basis of mutual trust and good faith, with respect to the supply of an indicated house (hereinafter referred to as “this project”) of the foregoing subject matter, B regional housing association (hereinafter referred to as “A”) and a member of the Committee (hereinafter referred to as “B”) who is the supplier, on the basis of the principle of mutual trust and good faith.
Article 6 (Contributions to Cooperative Members and Vicarious Execution Expenses)
1. Cooperative members' contributions (hereinafter referred to as "contributions") shall be all design costs, supervision costs, removal costs, and sales of all the project costs required for the promotion of the building project;
