1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. The Plaintiff’s assertion is a person who was in a de facto marital relationship with the deceased C (hereinafter “the deceased”) from 1978 to 30 years.

On June 23, 2010, the Deceased donated KRW 300 million to the Plaintiff by opening an account under the name of the Plaintiff and depositing money, but changed the donation amount to KRW 200 million on April 18, 201.

However, on July 26, 2011, the Defendant, who was the director of the accounting division of the deceased company, was an opportunity to keep the personal seal impression of the deceased, and withdrawn without permission KRW 200,000,000 from the account in the name of the deceased using his personal seal impression.

Therefore, the defendant is obligated to pay to the plaintiff KRW 200 million and damages for delay caused by the above illegal act.

2. Determination

A. The Plaintiff was de facto in a de facto marital relationship with the Deceased. The Defendant, as the director of the accounting division of D, operated by the Deceased, kept his legal entity and personal seal impression. On June 23, 2010, the Deceased opened an account number E in the name of the Plaintiff and deposited KRW 300 million in the said account at the IBK Enterprise Bank Operation Station (hereinafter “Financial Real Name Act”), and then withdrawn it as a certificate of deposit on October 1, 2010. On the same day, the Plaintiff opened the F account in the name of the Plaintiff at the same branch of the Bank, and deposited KRW 300 million in the said account on January 6, 201, and deposited it in the said account on the same day, and deposited KRW 300 million in the said account on the same day, and deposited KRW 300 million in the said account in the said account at the same branch of the IBK Operation Station, and deposited it on April 18, 2011.
