1. Basic facts

A. C completed the registration of the Ulsan District Court on September 28, 201 and the receipt of No. 94070 on September 28, 2011, regarding each real estate listed in the separate list owned by the Plaintiff, with the maximum debt amount of KRW 6 billion, the mortgagee C, the debtor, and the registration of the establishment of a mortgage, which is the Plaintiff.

(hereinafter referred to as “each of the instant collective security rights,” the registration of which was completed by C with respect to each of the real estate listed in the separate sheet, is “the establishment registration of each of the instant collective security rights.”

On November 8, 2011, Ulsan District Court Decision 201Kahap889, Ulsan District Court Decision 2011Kahap889 rendered a provisional injunction against the cancellation of the establishment registration of a mortgage due to the revocation of a fraudulent act, and completed provisional attachment order with the registration of Ulsan District Court as the provisional injunction No. 108571 on November 8, 201 and with the registration of provisional injunction No. 108571 on December 9, 2011 as Busan District Court Branch Branch 201Kadan4276 on December 9, 201, the provisional attachment order of KRW 3.25 million on the provisional attachment order with the Busan District Court and the Busan District Court No. 12351 on December 14, 201 as the provisional attachment order of KRW 1260,000 on November 2, 2012, the provisional attachment order of KRW 201.360,000 on December 1, 2012.

C. On September 12, 2014, Defendant Korea Industrial Development Co., Ltd. received a decision of provisional seizure of the claim amounting to 200 million Won District Court Branch No. 2014Kadan1244 regarding each of the instant collective security rights and completed the registration of Ulsan District Court and the registration of provisional seizure on September 19, 2014 as the receipt of the provisional seizure No. 97702.

Defendant B, on June 20, 2016, issued a collection order with respect to the claim of each of the instant collateral-backed claims that C holds against the Plaintiff by the Gwangju District Court Decision 2016TTT 2016T 51428, based on the above claim seizure and collection order issued.
