1. The Plaintiff (Counterclaim Defendant) paid KRW 19,140,143 to the Defendant (Counterclaim Plaintiff) and its related amount from August 22, 2018 to December 12, 2018.
Reasons
1. Facts of recognition;
가. 피고의 어머니인 D는 2002. 초경 건물을 건축하여 사용할 목적으로 원고로부터 서울 동대문구 E 대 150㎡(2017. 6. 5.경 C 토지에 합병되었다, 이하 ‘이 사건 토지’라고 한다)를 보증금 500만원, 차임 월 50만원, 기간 36개월로 정하여 임차하고, 2002. 4.경 이 사건 ㈎ 부분 지상에 가건물을 건축하고 매장 및 공장 용도로 사용하였다
(위 건물은 등기되어 있지 않고, 건축물대장에는 원고가 소유자로 기재되어 있다). 이후 이 사건 ㈎ 부분 지상 가건물에 덧붙여 이 사건 ㈏, ㈐ 부분 지상 건물이 각 증축되었다.
B. On July 24, 2015, the foregoing lease has been renewed several times, and the Defendant became a lessee, and entered into a lease agreement (hereinafter “instant lease agreement”) that leases the instant land from the Plaintiff with a deposit of KRW 20 million, KRW 1.5 million per month, and the period from July 24, 2015 to July 24, 2015 (hereinafter “instant lease agreement”).
C. Around August 17, 2017, around August 28, 2017, the Plaintiff sent to the Defendant a certificate of content as follows, but did not serve both.
3. When the term of the lease expires, I already notified you that you will remove the provisional building on the land and restore the building to its original state on several occasions, and deliver the land, but you may demand the value of the building and still not implement it.
4. That person himself/herself re-requests "re-exploiting a temporary building and delivering land upon the expiration of the lease term", and at least late 2015. (I seem to be a clerical error in 2017.)
8.I notify by the end of the year that the State will take legal action, such as civil and criminal action, if not implemented. D.
On the other hand, around September 11, 2017, the Defendant sent to the Plaintiff a certificate of content as follows.
Because one contract has been entered into in 2 to 3 years, it was thought that the contract will be entered into in this year.
