Punishment of the crime
1. A. A. Around August 2012, LA-related H requested L, a market manipulation expert, who was known to Pyeongtaek, to purchase shares to pay KRW 450 million to L, which was already in existence, for the debt amounting to KRW 450 million.
L, as above, after receiving a request from H, friendly Defendant A: “The account to sell and purchase J shares is sought, and the J shares are sold and sold as stated in the last sentence; Defendant A consented to this and thereafter, Defendant A transferred to L the securities account opened in the name of the principal, M, and E in this name.
L submitted L's market price manipulation orders using the securities account of relatives and branchs, such as the above securities account, and Defendant A also submitted L's direct market price manipulation orders in accordance with L's instructions, on the ground that Defendant A continues to hold an authorized certificate for the above securities account.
On the other hand, H, around September 2012, instructed Q from P (other companies operated by I and H) offices located in Yeongdeungpo-gu Seoul Metropolitan GovernmentO, Q, “P employees, take securities accounts from R and S, and manage them so that the J does not fall,” and Q, according to its instructions, opened the securities account from R and S and uses it.
