A defendant shall be punished by imprisonment for not less than eight months.

49,000,000 won shall be additionally collected from the defendant.

Punishment of the crime

Around May 2017, the Defendant: (a) established a corporation (i.e., one-time company; hereinafter “long-term company”) from B; (b) obtained a proposal from B to that effect that “I will open an account under the name of the corporation (i.e., a continuous passbook) and give KRW 30-5 million per account per each month when the cash card, etc. of the account is opened; (c) accordingly, B notified the Defendant of the method of establishment of the corporation, the method of making the bank and the false statement of transactions; (d) the Defendant obtained cash cards connected to the account and the OTP cards, etc.; and (e) conspired to transfer the name in return for B via B.

1. The Defendant and B, according to the above public offering, agree to establish a limited liability company C in accordance with the foregoing public offering. The Defendant and B, a certified judicial scrivener office, a certified copy of the Defendant’s resident registration, a certificate of personal seal impression, etc. necessary therefor, shall be issued to the certified judicial scrivener office’s office, and the Defendant shall prepare the articles of incorporation, a receipt of investment, etc. necessary for establishing the corporation through the employees of the certified judicial scrivener office. On May 19, 2017, the Seocho-gu Seoul Special Metropolitan City Central District Court shall submit to the registry office 14-3-3, Seoul Special Metropolitan City, to the registry office, a receipt of investment, etc. certifying the payment of investment, and shall require a registered public official without knowledge to enter the Defendant as a director, a trade name “limited liability company C,” a head office of Geumcheon-gu, Seoul Metropolitan City D buildings, and E, into the commercial electronic computer register which are the same as the original of the certified electronic document and enter the same facts as the original of the certified electronic document in the commercial register.
