A Imprisonment with labor for one year and a fine for 500,000 won, Defendant B, and Defendant C are punished by a fine of 5 million won.
Reasons
Punishment of the crime
1. Defendant A:
A. From September 1, 201 to December 2, 2011, from B operating the said company’s trade name, the constructor Co., Ltd., to perform the construction of the I building on the HI building in the Jeonsung-gun, Jeonsung-gun;
B. From October 5, 201 to December 28, 2011, the fact at the office of the J Co., Ltd. located in the Jeonsung-gun, the supplier column was issued a tax invoice of KRW 513,80,000 on the supply price column, “283,00,000” in the supplier column, “283,00,000” in the supply price column, and “28, 201.” In addition, from October 5, 201 to December 28, 2011, a tax invoice of KRW 513,80,000 was not supplied with goods or services as shown in the attached Table 1, and was issued to the supplier column; and
C. (1) On June 25, 2009, the business registration was made using the name of L for the purpose of evading taxes or evading compulsory execution, and (2) on June 30, 2009, the business registration was made using M’s name for the same purpose as that of the above (1) at the place described in the above (1) at the place described in the above (1) and (3) on May 27, 2010 using O’s name for the same purpose as the above (1), and the business registration was made using O’s name for the same purpose as above (1) at the place described in the above (1) at the place described in the above (1).
D. On May 27, 2010, the Ministry of Agriculture, Forestry and Fisheries received a passbook, password, and security card from O for the accounts in the name of the agricultural cooperative from O from NA in Syman-si, Agricultural Cooperatives and received the means of electronic financial transactions.
2. Defendant B is a person who actually operates Co., Ltd., the constructor, and is the first-mentioned person.
As described in the paragraph, A had A perform construction works using the company's trade name.
3. The defendant C Co., Ltd. does construction work by using the above company's trade name to another person with respect to the defendant's business, as described in paragraph (2).
