A defendant shall be punished by imprisonment for one year.

Punishment of the crime

1. On April 7, 2015, the Defendant: (a) extended a loan on condition that the Defendant created a right to collateral security on the vehicle owned by the Defendant, D with a maturity of KRW 4.5 million, and around April 7, 2018; (b) however, on condition that the Defendant would not repay the principal and interest of the loan, he/she received a loan of KRW 1.5 million from a non-creditor on the end of December 2016, and then assigned the said vehicle as security and did not repay KRW 1.5 million within the two-month period during which the reimbursement was made.

Accordingly, the defendant concealed the goods of the defendant, which is the object of the victim's right, and interfered with the victim's exercise of right.

2. The Defendant is a person who is in office as the director of the victim E Co., Ltd. from January 9, 2017 to June 9, 2017 and has been in charge of personnel management.

The Defendant is unable to cope with approximately KRW 50 million due to gambling at the end of May 2017, at his/her own monthly salary.

I think that the money owned by the victim is transferred to one's own account for the settlement of damages through gambling. On June 1, 2017, F, the representative of the victim, requested F, to allow him/her to perform his/her accounting duties, and received a certified certificate, OTP, password, etc. from the accounting staff.

After that, on June 2, 2017, the Defendant kept in the account of the Korean bank in the name of the victim at Pyeongtaek-si G and the office of the victim located in Pyeongtaek-si G and the third floor of the victim.

In addition to the transfer of KRW 500,000 to the Defendant’s Defendant’s Defendant’s wife H account, from around that time to June 9, 2017, the total amount of KRW 113,500,000 was transferred on nine occasions, such as the list of crimes, and then arbitrarily consumed around that time.
