A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. The Defendant is an individual constructor who established and operated D in Daegu Jung-gu, Daegu-gu, and who proceeds from office work.
The Defendant did not pay the monthly wage of KRW 2,33,33 on September 17, 2012, which was performed from September 17, 2012 to March 13, 2013, and KRW 5,00,00,00 each month from October 2, 2012 to February 2, 2013, and KRW 29,107,526, in total, KRW 1,74,193, and KRW 29,107,526, within 14 days from the date of retirement without agreement on the extension of the period.
B. The Defendant did not pay the monthly wage of KRW 1,200,000 for September 19, 2012, which was worked from September 19, 2012 to January 13, 2013, and KRW 11,458,064 for each month from October 2012 to December 2012, the monthly wage of KRW 3,000,000, and KRW 11,258,064 for January 2013 without agreement on the extension of the due date.
2. The Defendant of the 2013 Highest 6351 is an individual constructor who has an office in the five-story G-gu, Daegu-gu, and runs a construction business with ten regular workers.
When a worker dies or retires, the employer shall pay the wages, compensations, and other money or valuables within 14 days after the cause for such payment occurred.
The Defendant, at the foregoing office from February 25, 2013 to April 26, 2013, served as accounting and did not pay KRW 1,700,000 to H’s retirement on March 3, 2013, and wages of KRW 1,70,00 on April 2013, as shown in the annexed Table of Crimes, and did not pay KRW 19,62,350 for the total wages of four workers within 14 days from the date of retirement on which the cause for the payment occurred, without agreement on the extension of the due date between the parties.
3. "2013 Highest 6905" Defendant is an individual constructor residing in Daegu-gu G who runs a construction business with three full-time workers.
When a worker dies or retires, the employer shall, except in extenuating circumstances, such as an agreement on extension of payment period between the parties.
