Defendant A was sentenced to a suspended sentence of ten months of imprisonment with prison labor at the Incheon District Court on August 18, 2009 and the judgment on October 2, 2009 became final and conclusive on October 2, 2009.

1. Defendant A

A. The Defendant in violation of the Punishment of Tax Evaders Act is a person who established and actually operated a company B in the name of Yeonsu-gu, Incheon, E, the former wife No. 104.

On September 18, 2009, the Defendant issued a false tax invoice of the total value of KRW 962,00,000,000, in total, up to September 21, 2009, as shown in the attached list of crimes, as if he were to supply services equivalent to KRW 150,000,000, in spite of the fact that there was no supply of goods or services at the above office B, as if he were to supply services to F, a false tax invoice of the amount equivalent to KRW 150,00,00,000.

B. On September 22, 2009, fraud L agreed to purchase a promissory note in the face value of 1 billion won of the issuance of I Co., Ltd. (Foreign Exchange Bank J) holding by H and H around September 2, 2009, and provided K with the said promissory note as the collateral in advance, borrowing the down payment of 50 million won from K and paying it to H.

After that, the Defendant and G agreed to pay the above KRW 50 million to K, to find the said Promissory Notes from K to use them at a discount, and to borrow money from the victim L.

According to the above public offering, the defendant met the victim at the Dong-dong branch of the national bank in Songpa-gu Seoul Metropolitan Government on November 9, 2009 along with G around November 9, 2009, but G provided the victim with M's land and building as security, "I will pay 60 million won immediately after discounting a promissory note, and will transfer A's deposit of lease contract if I fails to comply with it," and the defendant will pay the victim the bill discount.
