A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant is a person who operates a cartoon room on the level D or 2 of Kimhae-si.
No one shall provide for the distribution or use of, or display or keep for, a game product that has not been classified as a rating, or exchange, arrange for exchange or repurchase of, such tangible or intangible results as scores obtained through the use of a game product.
Nevertheless,
1. From August 20, 2015 to August 19:15, 2015, the Defendant: (a) installed three game material for global Myleber (GLOBAL MyE FEV) game, which was not classified by the Game Water Management Committee, in the cartoon smuggling; (b) exchanged 10,000 won per 50 points for the points obtained by customers by games.
As a result, the defendant provided ungraded game water, and operated a business of returning tangible and intangible results obtained through the use of game water.
2. From November 2, 2015 to November 12, 2015, the Defendant: (a) installed three units for a “global machine” game that was not rated by the Committee on Water Management in the cartoon storage room in the cartoon storage room; (b) exchanged customers with cash of KRW 10,000 per 50 points earned through the use of game water by customers.
As a result, the defendant provided a game product that has not been rated for use, and exchanged intangible results obtained through the use of game products for business purposes.
