The punishment of the court below (the fine of 300,000 won) is too unreasonable.

Judgment

The fact that the defendant has divided his mistake and reflected his fault, and that it is difficult to maintain his livelihood due to suffering from liveration, etc. are favorable circumstances.

However, the crime of this case is insulting by the defendant. The defendant, despite the past records of assaulting and punishing the victim, is not sufficient to commit such crime, and it is not agreed with the victim until now, considering the circumstances that are already favorable to the defendant in the original trial, and there is no special circumstance or circumstance to be newly considered in sentencing after the sentence of the original judgment, and considering all the sentencing conditions of this case, such as the defendant's age, character and behavior, environment, background and consequence of the crime of this case, and the situation after the crime, it is not recognized that the sentence of the original court is too unreasonable. Thus, the above argument of the defendant is without merit.

3. As such, the defendant's appeal is without merit, and it is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act. It is so decided as per Disposition.
