A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

No one shall intermediate a third party's communications through telecommunications services provided by a telecommunications business operator or provide such services for a third party's communications.

Nevertheless, on August 16, 2019, the Defendant opened a national representative number under the name of the Defendant (B) around August 16, 2019, and provided a name-free person with each of the national representative numbers (C) around August 22, 2019, upon receipt of a proposal, the Defendant provided the Defendant with a name-free loan from his name-free persons. In order to rapidly proceed with the loan, the Defendant opened a national representative number under the name of the Defendant around August 16, 2019.

Accordingly, the defendant provided telecommunications services provided by telecommunications business operators for another's communications.

In using and managing the means of access, no one shall engage in any act of lending any means of access, except as otherwise expressly provided for in other Acts.

Nevertheless, around August 5, 2019, the Defendant listened to the phrase “E” from a person who has been contacted with the Defendant, that “I will grant a loan to the Party. If the loan is made, I would like to confirm whether it would normally pay the principal and interest, and thus, I would like to send a physical card under the name of the Party and request the identification number to be known.” On August 5, 2019, the Defendant lent the means of access to the name of the Party in return for the promise of sending one copy of the physical card connected with the F (G) account under the name of the Defendant through Kwikset Service, in front of the Seo-gu Incheon Seo-gu Incheon Seo-gu, Seo-gu, Incheon, Seo-gu, Incheon, Seo-gu, Seokset Island, which was 307, around August 5, 2019.
