Defendant

A is the representative director of E, a corporation that supplies food for school meal materials in Busan-gun D Office Office No. 101, and Defendant B is the representative of G in Busan-do F, and Defendant C is the guardian of G in Busan-gu, and Defendant C is the representative of I in H in Busan-gun, and Defendant C is the wife of Defendant A.

Defendants are living together with the head of Suwon-gu J apartment 105 Dong 706.

School meal Electronic Procurement System (htp: / eat.co.km) is limited to only one enterprise in the same City/Do, which is developed in order to enhance the fairness and transparency of the process of concluding food ingredients contracts, and is limited to only one enterprise in the same City/Do.

Defendants kept a certified certificate issued to each company they represent at G office, shared the bidding price for the supply of school meal materials, offered duplicate bids in the name of Co., Ltd. E, G, and I, and recruited mutually to increase the successful bid rate.

According to the above public offering, at around October 27, 2015, the Defendants bid in the name of the “L” public bid to be supplied to K high school in the name of the said G office, and subsequently bid in the name of I and E, and eventually, in the name of G, the bid price of KRW 16,907,00 for the above contract was awarded in the name of the said G, thereby impairing the fairness of the school meal tender by winning the contract and doing so from October 27, 2016 to October 27, 2016, the Defendants were awarded the contract for the school meal supply of a total of KRW 1,303,490,776 in the same manner as in the list of crimes in the attached Form.

As a result, the Defendants conspired in collusion to impair the fairness of school meal tender.
