A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime
[B] Around October 201, the Defendant entered into a contract with the (ju) Ginnas, Ginnas, to purchase 15 tons of rare soil in US$690,000 (Korean Won KRW 784,00,000) and deliver US$705,000 (Korean Won USD 818,505,000) in Ginnas, respectively, to the (ju) Ginnas, Linnas, and (ju) Ginnas, Linnas, which are located in Ginnas, to supply them to US$705,00 (Korean Won USD 818,505,00) in D operations.
The terms and conditions of the contract are as follows: (a) around October 14, 201, the Defendant received goods from the Linbys and delivered them to the (ju) Sinbys on the day to the (ju) Sinbys on the day, and (b) paid in full the price to the (ju) Sin by Lins; and (c) some of the price shall be 70% (US$ 493,500) the price to be paid in advance by Lins by Lins, and the remainder shall be paid in the amount that the Defendant created.
In addition, the Defendant agreed to receive 30% (US$ 211,500) of the remainder of the goods within 14 days after delivery from Korea Telecommunication Co. (U.S.).
(1) On October 14, 201, the Defendant: (a) around October 201, at the F Office in charge of the Defendant’s operation of the building located in Yangcheon-gu Seoul Metropolitan Government, the Defendant was expected to purchase and supply the Victim G with 15 tons of rare soil from the Defendant’s office located in Yangcheon-gu, Seoul; (b) the Defendant was expected to receive and deliver the remainder from the Defendant’s office in charge of the Defendant’s operation of the building; and (c) the Defendant was transferred from the Defendant’s bank account in the Defendant’s name of H on the day of borrowing KRW 235 million from the Defendant’s office with the Defendant’s “Seungpo-si, G.,” and the 70% of the remainder would be paid from the Lanchi-si’s advance payment. However, if the remainder would have to be provided with the remainder, the Defendant would have received and repaid the remainder from the Lan.
However, the Defendant, who continues to pay the remainder after the date of payment, received an extension from the victim several times, and finally, was extended on December 9, 201 by December 15, 201.
In this regard, the Defendant received USD 171,500 from Korea T&C around December 15, 201.
