1. Defendant E, F, and G jointly share the amount of KRW 35 million to Plaintiff A, and the amount of KRW 20 million to Plaintiff B and each of the said amounts.
Reasons
1. Basic facts
A. On April 14, 2014, at the office of I Licensed Real Estate Agent located in Asan-si operated by Defendant F, which is a licensed real estate agent, Defendant C and D (hereinafter “J 205”) entered into a lease agreement with Defendant E who represented the said Defendants with regard to the second floor and second floor of the J-family house in ASEAN-si owned by Defendant C and D (hereinafter “J 205”), setting the lease term as between May 12, 2014 and May 11, 2015.
At the time, the lessor column of the lease contract (No. 2-1) prepared and output by using the computer at the time stated "D and one other", and the name of the defendant C and the defendant D is stamped, and his agent bears the name of the defendant E and affix his seal.
The broker column stated the "F" as the representative F of the International Licensed Real Estate Agent Office, and the name of the defendant F is affixed with a seal affixed thereon.
Article 8 of the Agreement stipulates that 0.5% of the transaction price shall be paid as brokerage commission, and the document confirming the object of brokerage affixed with the seal was prepared and printed in a computer according to the form prescribed by Defendant F, along with the preparation of the Agreement, and was delivered to the said Plaintiff.
The above Plaintiff deposited the down payment of KRW 3.5 million in the Defendant E’s account on the same day, deposited the down payment of KRW 14.5 million in the above Defendant’s account on May 9, 2014, and deposited the remainder of KRW 17 million in the Defendant’s account notified by the above Defendant on the 12th day of the same month.
However, Defendant E, instead of J 205, moved to the above Plaintiff at the time similar to J 207 at the same time as J 205, and the Defendant C’s 307 floor at the Asan City of Co-ownership of K and Defendant C (L 307). The above Plaintiff moved to L 307.
B. On June 14, 2014, Plaintiff B, at the office of the said I Licensed Real Estate Agent, hires Defendant E and J 205, with the lease deposit amounting to KRW 35 million, and the lease term from June 17, 2014 to June 16, 2015.
