1. Defendant B pays KRW 2,380,000 to the Plaintiff.
2. The plaintiff's remaining claims against the defendant B and the defendant C.
Reasons
1. Facts of recognition;
A. On January 20, 1997, Defendant B leased 10 square meters of the instant building from G from January 20, 1997 to KRW 9 million of deposit money, and KRW 170,000 of rent monthly, and operated a fireworks at all times.
B. The Plaintiff purchased the instant building from G and completed the registration of ownership transfer on February 22, 2012, and the lease agreement on the instant building including the said lease agreement was succeeded to the Plaintiff.
(A) Defendant B’s lease contract succeeded to the Plaintiff (hereinafter “instant lease contract”). 【No dispute exists, entry in the evidence Nos. 1 and 2, and the purport of the whole pleadings.”
2. As to the claim for extradition of this case, the Plaintiff voluntarily acknowledged that the Defendants had withdrawn from the building of this case (the preparatory document dated August 23, 2018), the part of the claim for extradition among the claims of this case is without merit, without further review.
3. As to the claim for the money of this case
가. 청구원인 원고는 ① 피고들이 임차한 꽃집(별지 건물평면도의 ㈐ 부분)에 대해서는 2012년 4월분부터 2015년 11월분까지의 기간에 대한 미지급 차임(약정 차임 17만 원 중 10만 원만을 지급받았으므로, 월 7만원씩 미지급됨)인 합계 3,080,000원(= 44개월 × 70,000원)의 지급을 구하고, ② 채소가게(별지 건물평면도의 ㈑ 부분)에 대해서는 피고들이 이를 무단 점유하였다는 전제에서, 2015. 1. 1.부터 2017. 10. 31.까지 기간에 대하여 (종전 임차인과의 약정 차임이었던) 월 28만 원의 비율로 계산한 부당이득금 합계 9,520,000원(= 34개월 × 280,000원)의 지급을 구한다.
B. 1) On the Plaintiff’s claim against Defendant B, even if based on the Plaintiff’s assertion, Defendant B remitted only KRW 170,000,000 to Defendant B, not KRW 174,000,00,000. During that period, there was no content-certified mail (No evidence No. 4 points out that part of the rent was unpaid, and Defendant B sent to Defendant B in 2015.
