Punishment of the crime
[Judgment of the court below] Defendant A is the actual representative of Defendant B, and Defendant B is a corporation that runs a petroleum sales business (general agency) and C (Additional shipment and D) is an oil tanker owned by Defendant B and its navigation area is the near coastal water area.
【Criminal Facts】
1. Defendant A
(a) No petroleum retailer in violation of the Petroleum and Petroleum Substitute Fuel Business Act shall be supplied with petroleum products supplied or supplied by petroleum refiners, petroleum exporters or importers, or other general agencies and sell them to other general agencies, gas stations, general retail shops, or end-consumers;

(b) No employee of a shipowner in violation of the Marine Environment Management Act shall use light oil exceeding 0.05% (weight %) of the sulfur content as fuel oil of a ship sailing only in the territorial sea and exclusive economic zone.
Nevertheless, around April 25, 2019, the Defendant purchased 25 drums (5,000 litres) via 0.13% (weight %) of sulfur content at the 5 fatherhead of Busan Port located in the 1116 Busan East-dong, Busan-dong, Busan-dong, and used it as the fuel oil of the above C from around that time to July 2019.
2. Defendant B
A. The defendant in violation of the Petroleum and Petroleum Substitute Fuel Business Act is an employee of the defendant A in relation to the defendant's business.
The same violation as the paragraph was committed.
B. The Defendant is an employee of the Defendant in violation of the Marine Environment Management Act.
