All appeals filed by the defendant and prosecutor are dismissed.

1. The summary of the grounds for appeal that the prosecutor appeals against the defendant (the defendant did not submit the grounds for appeal). 2. The prosecutor's above assertion disputing this point cannot be accepted, in full view of not only the grounds for sentencing unfavorable to the defendant, but also the motive and background leading up to the crime of this case, the violation of traffic safety caused by the crime of this case, the degree of social danger, and other circumstances shown in the argument of this case, including the defendant's age, character and behavior, family form, and circumstances after the crime.

3. Accordingly, we cannot accept all appeals filed by the Defendant and the prosecutor without holding any pleadings in accordance with Article 364(5) of the Criminal Procedure Act.
