A은 2016. 11월 말경부터 2017. 2. 16.까지, 피고인 B는 2017. 2. 17. 경부터 2017. 2. 28. 경까지 각각 위 게임 장에 구룡 영웅전 게임기 40대를 설치하고, 위 게임기의 시작 버튼을 자동적으로 눌러 주는 속칭 ‘ 똑딱이’ 장치를 구비한 후, 그 곳을 찾은 손님들이 현금을 위 게임기에 투입하면 게임이 자동으로 실행되어 우연한 결과에 따라 점수를 획득하는 방법의 게임을 손님들에게 제공하는 방법으로 게임 장을 운영하면서, 환전 상인 피고인 C를 고용하여 피고인 C로 하여금 2017. 2. 14. 13:31 경 위 게임 장을 찾은 성명 불상의 손님에게 4만 원을 환전해 주고, 같은 날 13:43 경 성명 불상의 손님에게 19만 원을 환전해 주고, 같은 날 13:58 경 성명 불상의 손님에게 4만 원을 환전해 주도록 한 것을 비롯하여 위 각 영업기간 내에 그 곳을 찾아오는 불특정 다수의 손님들 로 하여금 게임을 하게 하고, 손님들이 게임의 결과로 취득한 점수를 1점 당 1원으로 환산하여 수수료 10%를 공제한 액수로 손님들에게 환전해 주었다.
