Reasons
1. Basic facts
A. The Defendant leased shopping mall No. 4, E, and F (hereinafter “instant store”) in Ansan-si, a member-gu, and operated an empty land clothing sales business in the name of “G” at the same place.
B. Around June 16, 2016, the Plaintiff and the Defendant concluded a transfer contract on the instant store (hereinafter “instant transfer contract”), and the main contents thereof are as follows.
The transferor and transferee of a real estate right transfer contract shall enter into a sales contract for real estate rights with the following indication:
In the location of indication of real estate in Ansan-do, Gyeonggi-do, the number of clothes permission (public column) for the business of 51.24 square meters in the Myeon of Dong-gu C Building D, E, H, F, and G in the Dong-gu, Ansan-do.
2.To pay the amount of rights and the amount of rights on the property above Article 1 of the Terms of Contract as follows:
Amount of KRW 8,500,000 for the limit of KRW 1,000 shall be paid at the time of the contract and shall be paid in June 20, 2016 for the remaining amount of KRW 7,500,000 for receipt.
Article 2 The transferor shall transfer to the transferee by the day before the commencement of the lease contract with the condition that it can exercise the right of the above real estate, and the transferor shall remove all the circumstances impeding the exercise of the right of lease and deliver all the facilities and goodwill to the transferee so that the transferee can conduct business immediately at the time of receipt of the balance
Article 3 Reversion of profits and taxes and public charges incurred in relation to the above real estate shall be imposed on the transferor until the date of delivery of the above real estate until the date of its transfer, and those thereafter shall be reverted to the transferee.
Article 4 (3) The transferor shall endeavor to conclude the lease agreement with the owner and the transferee as much as possible on the basis of the following terms and conditions of the lease agreement with the owner and the transferee before the payment date of the balance.
