피고인은 2014. 9. 17. 20:40경 서울 도봉구 B 지하 1층 ‘C노래연습장’에서 사복을 입고 단속 중인 경찰관 피해자 D에게 노래방 업주 등 3명과 불특정다수의 노래방 손님들이 듣는 가운데 아무런 이유 없이 “니미 씨벌, 어떤 놈이 공무를 집행하고 있어 , 신분증을 보여만 주지 말고 줘봐, 대한민국법이 양아치들 법이냐 , 야 씨발놈아, 니 신분증부터 까, 개새끼야, 너 경찰공무원이라 했지 , 확실히 까봐, 이 새끼 호로 새끼네, 개새끼가 경찰공무원 맞아 ”라고 큰소리로 말하여 공연히 피해자를 모욕하였다.
