A defendant shall be punished by imprisonment for not less than two months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On May 24, 2019, the Defendant written a letter to sell in 860,000 won by accessing the building C to the Government of Gyeonggi-si, the mobile phone in No. D, and selling 3 of golf-sab to 860,000 won. In the event the Defendant sent money to the victim E who reported and contacted the above letter, he/she would sell 3 of the golf-sabs.

However, in fact, the defendant did not have the above golf spread, and he thought that he would receive money from the victim and use it for the cost of living. Even if he received money from the victim, he did not have the intention or ability to sell the golf spread.

The Defendant, as above, by deceiving the victim, received KRW 860,000 from the victim on the same day.

2. On May 28, 2019, the Defendant written a false statement that he/she had access to the building C at the Government of Gyeonggi-si, and that he/she sold a golf distance measuring device of KRW 480,00 by 480,00,00, and that he/she would sell a golf distance measuring instrument of KRW 480,00 to the victim B who reported and contacted the above writing.

However, the defendant did not have a golf distance measuring instrument, and he thought that he would receive money from the victim because of no economic situation. Even if he received money from the victim, he did not have the intention or ability to sell the golf distance measuring instrument.

The Defendant, as above, by deceiving the victim, received KRW 480,000 from the victim on the same day.

Accordingly, the defendant deceivings victims twice and received a total of KRW 1,320,000 from the victims.
