A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Around 17:40 on June 17, 2018, the Defendant violated the Road Traffic Act (unlicensed Driving) driven a CM7 car at a section of about 3 km without a vehicle driver’s license from the front side of Seocheon-si B lending to the front side of the interest-distance 140, Bupyeong-gu, Incheon, Bupyeong-gu.
2. The Defendant is a person who is engaged in driving service of CM7 vehicles.
Around 18:00 on June 16, 2018, the Defendant driven the above vehicle and proceeded at a speed of about 40 km from the direction of the Jinjin-gu, Incheon, to the speed of about 140 km along that of the Bupyeong-gu, Incheon.
The place has an intersection at the front and right-hand turn, and in such a case, the driver of the vehicle has a duty of care to safely pass through the intersection according to the prescribed lane.
Nevertheless, the defendant neglected to turn to the left without a driver's license and neglected to do so, and the victim D(36 years of age) driving along the lane set on the right-hand side of the defendant's proceeding direction, which was driven by the victim D(36 years of age).
Ultimately, the Defendant, by occupational negligence, suffered injury to the victim D, such as salt, tensions, etc. of tensions, which requires treatment for about two weeks, from the victim F (36 years of age, female) who was on the back seat, the injury of climatic salt, tensions, etc. requiring treatment for about two weeks; the injury of climatic salt, tensions, etc. requiring treatment for about two weeks to the victim G (5 years of age, female) who was on the same part; and the injury to the victim H (3 years of age, female), such as climatic salt, tensions, etc. requiring treatment for about two weeks.
