In accordance with the records, the prosecutor's facts charged are modified or supplemented to the extent that it does not adversely affect the defendant's right of defense and actually affect the contents of the facts charged, thereby bringing about a change in the subject of trial by the court.

Around 09:30 on June 23, 2019, the Defendant arbitrarily removed the buildings owned by the Victim C, ① 6.2 square meters in the B of the Shacheon-gun, Hongcheon-gun (hereinafter “instant building”); ② 89 square meters in the storage of the prefabricated-gun, prefabricated-gun, ③ 100 square meters in the steel prefabricated-type car center; ④ 31.6 square meters in the prefabricated-type car center; ⑤ 18 square meters in the warehouse; and 6.1 square meters in the aggregate of 248.9 square meters in the area of 4.1 square meters in the annexed building of the steel framed-type (see, e.g., evidence records) (i., 6.2 square meters in 89 square meters in 100 square meters in 31.6 square meters in 18 square meters in the same manner).

Accordingly, the defendant damaged the property owned by others.

1. Summary of the defendant and defense counsel;

A. The Defendant does not in itself have any fact of removing the instant building, i.e., destroying it, and the said building still remains.

B. The instant case 2, 3 each building is to be demolished by the Defendant (the instant building was partially demolished), but the “D”, the former lessee, newly constructed each building and sold it to the “E,” the lessee, and the “Defendant” again purchased it from the above E. The ownership of the Defendant is not owned by another person, and even if it is owned by another person, there is no intention to destroy it at the time of removal by the Defendant.

C. Each building of this case (4), (5), and (6) is the removal of each building by the Defendant, but since all the Defendant was newly built by the lessee, the ownership of the Defendant is not owned by another person, and even if it is owned by another person, there is no intention to destroy this point at the time of removal by the Defendant.
