1. Defendant A
(a) The defendant shall be punished by imprisonment with prison labor for ten months;
(b)Provided, That the above sentence shall be imposed for a period of two years from the date this judgment becomes final and conclusive;
Reasons
Punishment of the crime
Defendant A, the representative director of Defendant G Co., Ltd. established for the purpose of running the soil industry, etc., Defendant B and Defendant C are those who perform the duties of funding and official duties of Defendant G Co., Ltd., Defendant D and Defendant E are those who actually run Defendant H established for the purpose of running the soil industry, etc., and Defendant F are those who actually run the soil industry, etc.
(State) On October 201, Korea Land Trust ordered S Co., Ltd. to construct a new complex building on the main and four lots outside R and D (hereinafter “the instant site”) at the time of the Gyeonggi-si (hereinafter “the instant site”). S Co., Ltd., a contractor, subcontracted the construction work (defation of the site) and the installation work (soil) to T Co., Ltd., and T Co., Ltd re-subcontracted the relevant land construction to G.
Since then, in the case of G, while carrying out the soil work at the site of this case, the work on the vehicle for transporting earth and sand subject to the ground destruction and removal should be conducted in G, and the above work on the removal of earth and sand was sub-subcontracted to H, a stock company, and H had U.S. and Defendant F perform the work on the removal of earth and sand by sub-subcontracting it to U.S. around January 2012. On February 20, 2012, H continued to perform the work on the removal of earth and sand by re-subcontracting the relevant contract to I.

The site of the instant joint crimes committed by Defendants A, B, C, Defendant D, Defendant E, and Defendant F was installed before the factory was removed only from the ground structures of the relevant factory, and some wastes (waste concrete, waste soil and stone, etc.) not disposed of during the process of removal are stored at the site.
