Defendant
A shall be punished by imprisonment with prison labor for six months and by imprisonment with prison labor for one year.
However, for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
No one shall engage in a similar receipt business in which an unspecified number of persons agree to pay the total amount of contributions or an amount in excess thereof in the future without obtaining authorization or permission, making registration or making a report, etc. under other Acts and subordinate statutes, and which is engaged in the business of receiving contributions.
E: (a) A person operating a G farming association corporation in Busan City; (b) introduced H et al. with a multi-level organization in early 2016, and recruited the head of a center to attract investors in each region across the country to attract an unspecified number of investors; and (c) planned to receive 17,406 won per day except for public holidays until the amount reaches KRW 2,00,000,000, when investing funds from investors; and (d) planned to pay 17,406 won per day to the suspect introduced through H and I, etc., on condition that the amount of 5% of the annual sales of each State center would be paid to the suspect who received funds through H and I, and the suspect would like to accept such a similar receipt in the above manner.
1. Defendant A, as such, and registered as the head of Dong-gu Office of G Agricultural Cooperative, with Defendant A, etc., and on February 22, 2016, the Defendant would pay 17,406 won annual allowances, except for public holidays, until the amount reaches KRW 2,00,000,000 for the investment amount of KRW 1,20,000,00.
The purpose of “investment agreement with the J is to enter into an investment agreement with the J and to receive KRW 1,200,000 corresponding to one unit in cash on the same day as the investment deposit, as well as to receive from the J, from around that time to June 20, 2016, as shown in the Schedule of Attached Crimes (1) to June 20, 2016, the said investment agreement is entered into with investors as above and the sum of 529 times in total.
