A defendant shall be punished by imprisonment for seven years.
The defendant shall be ordered to complete the sexual assault treatment program for 80 hours.
Reasons
Punishment of the crime
1. Around 01:30 on September 2, 2015, the Defendant violated the Punishment of Violences, etc. Act (collectively, deadly weapons, etc.) (collectively, deadly weapons, etc.), the Defendant parked a vehicle on the front of the residence of the victim D (n, 25 years of age) who was sexually female-friendly arrested by the Defendant (hereinafter “victim”), and did not go to the victim despite the Defendant’s request, despite the Defendant’s demand that the Defendant walk the vehicle. The Defendant made the victim go to the front line by threatening “I would go out of Korea, I would see that I would have come to go to the front line of the vehicle.” The Defendant continued to drive the vehicle, which is a dangerous object that the victim tried to get off, and would have been prepared in advance at the front place of receiving the vehicle’s seat at the time of the request of the victim to get off the vehicle, and the Defendant continued to drive the apartment vehicle up to 15m in the vicinity of the apartment after leaving the apartment by the victim.
Accordingly, the defendant carried dangerous objects and detained the victim by threatening him.
2. Around 02:00 on September 2, 2015, the Defendant: (a) parked the said vehicle in the said E apartment parking lot; (b) took the attitude of showing the victim as being dangerous to the victim after drinking the vehicle; (c) let the victim resist; and (d) forced the victim not resist; and (c) let the victim go out of clothes; and (d) sexual intercourse with the victim.
Accordingly, the defendant, with dangerous objects, has been raped by threatening the victim.
3. Around 05:00 on September 2, 2015, the Defendant: (a) arrived at the victim G (the 24-year-old age) residence of the victim G located in the G (the 24-year-old age); and (b) entered the first floor restaurant of a residential building, and found the victim D, but there was no victim H (the 53-year-old age-old), the mother of the victim G.
