The judgment below

The part against the defendant shall be reversed.

The punishment of the accused shall be determined by six months of imprisonment.

(b).

1. The summary of the grounds for appeal is acknowledged that the Defendant conspireds with B and E, by informing B of the detailed methods of the insurance fraud crime, and paying the insurance premium for six months for the insurance fraud, in the event that B and E leaves the insurance fraud crime as indicated in the judgment of the court below.

However, the judgment of the court below that acquitted the defendant is erroneous.

2. 판단 원심이 적법하게 채택하여 조사한 증거 및 당심 증인 B, E의 각 증언에 의하여 인정되는 다음과 같은 사정, 즉 ① B는 당심에서 “피고인이 저에게 순천 I병원에서 수술하면 입원도 시켜주고 입원기간도 늘려주고 입원도 오래 할 수 있다고 했다. 보험설계사 소개도 피고인이 해 줬다. 15개가 넘는 보험에 가입하였는데 처음 6개월 정도는 피고인이 납입해 주었다. 제가 돈이 없으니까 보험금이 나오기 전까지는 해주기로 하고, 그것을 나중에 갚기로 했다. 피고인도 보험사기에 대해서 다 알고 그렇게 한 것이다. 보험금을 청구할 때 사고일자나 사고경위를 기재하는데 그 부분은 피고인이 알려주는 대로 했다. 제가 무릎이 안 좋아서 계단에서 내려오다가 삐끗했다고 했는지 정확히 기억은 안나는데 피고인이 그런 식으로 이야기하라고 했다.”라고 구체적이고도 상세하게 증언한 점, ② B는 수사단계에서도"제가 돈 때문에 힘들어 하니까 (주변 사람이) 몫돈을 만질 수 있는 방법이 있다고 하면서 피고인을 소개를 해 주었습니다
